A 13-year-old was allegedly backing a minivan into a man’s driveway when the teen “rapidly accelerated,” running the man over, according to New York State Police.

Abraham Moskovits, 36 – who was run over by the vehicle – was “extricated from underneath the vehicle” and rushed to Good Samaritan Hospital in Rockland County, N.Y., where he later died, according to police.

Shortly before 9 p.m. on Tuesday, Oct. 22, Monroe barracks troopers responded to a report of a pedestrian struck by a vehicle in the village of Kiryas Joel in the town of Monroe, N.Y.

The 13-year-old – whose name has not been released based on the teen’s age – was allegedly backing a 2024 Honda Odyssey into Moskovits’s driveway and “while attempting to back the vehicle into the spot” hit the gas pedal, according to preliminary findings released by police.

Trooper Jennifer Alvarez tells PEOPLE that “there is no indication of criminality in this incident” and that state police are not pursuing criminal charges in the case.

When asked to elaborate on that decision, as well as about any potential traffic violations that could be pursued, Alvarez responded by email that: “The case was investigated and it was determined not to be a criminal matter.”

New York state law forbids anyone under the age of 16 from driving– even if they have a permit or license from another state.
